Customer Credit Application

All Accounts are due and payable within thirty (30) days, unless otherwise stated on your customer agreement. Any unpaid amounts shall bear interest at the rate of 1.5% per month (18% APR) after 30 days. All amounts due shall be payable with all costs of collection and reasonable attorney's fees. This agreement is made and entered into agreement in Warsaw, Indiana and shall be construed in accordance with the laws of the State of Indiana and exclusive jurisdiction and venue is granted to the state courts located in Kosciusko County, Indiana. Customer authorizes individual and business investigations and if requested agrees to furnish a current financial statement or sufficient information for compilation of a current financial statement. Customer warrants that all financial information submitted shall be true and correct and that credit will be extended based on the accuracy of the financial information furnished by the customer. If credit is granted, customer agrees to the terms noted on each invoice. No terms or conditions of purchase orders different from the terms of Creditor will become a part of any sale agreement, purchase order or other document unless specifically approved in writing by Creditor. Customer acknowledges that he/she has read the terms and conditions stated herein and agrees to all of them. In consideration of Warsaw Chemical Holdings LLC extending to the Company shown on this application, the undersigned jointly and severally agree to be personally liable for the payment of any amounts owing to Warsaw Chemical Holdings LLC. A faxed or e-mailed copy of this application will be considered an original.
